SUMMARY:

Approval for transfer of certain university property. Requires the approval of the General Assembly and the board of visitors of a college founded in 1693 (the College of William and Mary) for the transfer or disposal of state-owned property in the possession or control of the college. The approval of the board of visitors shall be by a two-thirds vote of all board members at a regularly scheduled board meeting. Under current law (§ 2.1-505), state agencies and institutions, such as public colleges and universities, holding or controlling state-owned property that is not being used are to notify the Department of General Services (DGS). The Department, in turn, periodically inquires of all state institutions regarding the use of property to determine whether any property should be declared surplus to the needs of the Commonwealth. DGS also establishes criteria for determining whether property is “surplus” to the “current or proposed needs” of the institution. The maintenance of any property declared surplus by DGS remains the responsibility of the institution, unless, upon a DGS recommendation, the Governor authorizes the transfer of such property to the possession or control of DGS.
