SUMMARY:
Punitive damages. Provides that the total amount of punitive damages collectible from an individual defendant not exceed the greater of $350,000 or five percent of the defendant's net worth. Establishes eight factors to be considered by the trier of fact in determining amount of damages. Repeals § 8.01-38.1 which places the cap at $350,000 total for all defendants.
