SUMMARY:
Motor vehicle insurance; uninsured motorist insurance coverage. Shifts the costs of defense from an underinsured motorist's (operator) liability insurer to a claimant's underinsurance carrier whenever the operator (i) tenders the operator's liability insurance policy limits to the claimant and (ii) notice of such tender is provided to the underinsurance carrier. If, upon final resolution of the claim, the total liability of the operator is less than the policy limits previously tendered, the operator's carrier forfeits its rights to be indemnified by the underinsurance carrier for such defense costs.
