SUMMARY:

Public utility; solid waste management facilities. Excludes from the definition of “public utility” in the Utility Facilities Act, companies selling landfill gas from a solid waste management facility to a public utility regulated by the State Corporation Commission (SCC) which provides gas distribution service to the public in the area in which the landfill is located. If a company wishing to sell landfill gas to such a public utility submits a written offer to the utility and the utility does not agree to purchase the gas within 60 days, the company can then sell the gas to (i) any state-owned or -operated facility within three miles of the landfill or (ii) any purchaser after the gas has been liquefied. The bill exempts any city having a population of between 64,000 and 69,000 and any county having a population of at least 500,000 from the foregoing provisions. The bill also empowers the SCC to regulate the safety of landfill gas facilities.
