SUMMARY:
Refusal to take blood or breath test. Provides enhanced punishment for refusal to take a blood or breath test pursuant to a DUI arrest if there have been previous convictions for refusal, DUI (§ 18.2-266) or zero tolerance (§ 18.2-266.1). Where there has been one previous conviction, the period of license suspension is increased from one to three years. For more than one previous conviction, the suspension period is extended to 10 years.
