SUMMARY:

Disclosure of certain pupil and family information. Requires written pupil or parental consent for disclosure of personal or family information sought through any survey, analysis, evaluation, or treatment offered as part of a school guidance, instructional or other educational program or school activity. Specifically, this measure protects the disclosure of information regarding political or religious affiliations; mental or psychological conditions; sexual behaviors, orientations, or attitudes; illegal or anti-social behaviors; critical appraisals of persons with whom the pupil or pupils' family has a close family relationship; certain legally recognized privileged or confidential relationships, such as those with legal counsel, medical personnel, or clergy; and income except when required by law to determine certain program or financial need eligibility.

Parents shall have access to all instructional materials used in support of these surveys or information requests. School boards must provide pupils and parents with two weeks' written notice of the survey or evaluation. The notice shall describe the information sought as well as the use, purpose, evaluation, access, and subsequent disclosure of the pupil or family information. This measure mirrors the requirements of the federal Parents' Rights Restoration Amendment in Goals 2000, passed by Congress in March, 1994, as P.L. 103-227, and codified at 20 U.S.C. § 1232h.
