SUMMARY:
Workers' Compensation; State Corporation Commission review of proposed premium increases. Authorizes employers insured under a policy of workers' compensation insurance to seek review by the State Corporation Commission of any premium increases sought by the insurer in conjunction with the renewal of the policy. The State Corporation Commission, while not permitted to substitute its underwriting judgment for that of the insurer, may require the insurer to recalculate the premium if it determines that the premium sought does not (i) conform to the insurer's filed rate then applicable to such insurance, (ii) reasonably reflect the insured's risk classification or claims experience, or (iii) incorporate an accurate experience modification.
