SUMMARY:

Designation of Outstanding Natural Resource Waters. Requires an act of the General Assembly and an affirmative vote of affected local governments before a water body or a segment of a water body may be designated as an Outstanding Natural Resource Water (also known as “Exceptional Waters” or “Tiers III Waters”). When the Department of Environmental Quality receives a nomination of a water body or segment for Outstanding Natural Resource Water status it is to make a preliminary assessment of whether or not the water meets the requirements for such designation. If the Department finds that there is potential to meet the designation criteria, it is to submit the preliminary assessment to the General Assembly. Any member of the General Assembly may then introduce legislation to designate the water body or segment. Local governments have 120 days following the effective date of such legislation to vote in favor or against designation. No General Assembly or local government approval is required for designation of waters that are within the boundaries of federal or state park lands and which do not affect any locality.
