SUMMARY:
The Virginia Equal Access to Drug Discounts Act. Requires manufacturers doing business in the Commonwealth to offer or accord to any purchaser the same terms and conditions that are offered to the most favored purchaser doing business in this state. Definitions are provided, including 'purchaser,” “covered transaction” and “manufacturer.” Examples of entities not considered “purchasers” are federal and state programs directly procuring drugs and the Virginia Department of Medical Assistance Services, closed-shop pharmacies, hospitals, and charitable health care providers. Civil penalties are established for violations of this act. A purchaser will be able to sue for treble damages.
