SUMMARY:

Certificates of public need; moratorium on nursing facilities. Provides an exception to the moratorium on nursing home construction to an existing facility which currently contains 325 “independent living” units with home health services, 75 assisted living units, and 31 nursing facility beds, only five of which are certified for the use of Medicaid recipients, if the total number of beds to be constructed does not exceed 30 beds, the facility agrees in writing not to seek certification for the use of any such beds by persons eligible to receive Medicaid, that the beds will be confined to use by present or prospective residents of the condominium units, and that only residents of the retirement community will be admitted to the nursing facility beds after the first three years of operation.
