HB 2149 Notice of juvenile intake petition.

SUMMARY:
Notice of intake petition. Requires the intake officer to give notice of the filing of a petition alleging that a juvenile committed a specified felony to the superintendent of the school division or principal or headmaster of the private school in which the juvenile is or should be enrolled. The specified felonies are identical to those for which notice of disposition is to be provided to the superintendent. The notice of disposition provision is expanded to require notice to be sent to private school principals and headmasters.
Failure to provide school-related information is not grounds for refusal to file a petition.
Disclosure of the information to the principal of the juvenile's school by the superintendent is limited to those situations where the principal determines disclosure is necessary to ensure the physical safety of the juvenile, other students or school personnel. A public or private school principal or headmaster may further disclose the information only after the juvenile is taken into custody and then only to persons in actual physical danger.
