SUMMARY:

Civil procedure; unlawful detainer actions. Provides for the removal from general district to circuit court of unlawful detainer actions involving residential tenancies which do not arise from a default in rent if the defendant (tenant) files an affidavit of substantial defense and pays the requisite costs. The defendant remains obligated to pay rent. If he fails to do so and the plaintiff files notice of the default with the circuit court three days after service of the notice on the tenant and continued nonpayment, the landlord is entitled to immediate possession.

Unlawful detainer actions are to be given priority on the circuit court's docket.
