SUMMARY:

Mental health; outpatient commitment. Establishes criteria for the judge to use in determining the appropriateness of outpatient commitment for an individual who is the subject of an involuntary commitment proceeding. Before outpatient commitment may be ordered, the judge must find that the patient understands the treatment proposed, the patient wants to live in the community and agrees to comply with the treatment plan, the patient has the capacity to comply with the treatment plan, and the ordered treatment can be monitored by the relevant community services board or designated providers. This bill is a recommendation of the Joint Subcommittee Studying the Effects of Deinstitutionalization (HJR 139).
