SUMMARY:
Administrative Process Act; discovery and judicial review. Authorizes discovery proceedings in accordance with Title 8.01 and the Rules of the Supreme Court. The bill also (i) requires agencies to provide detailed explanations of the factual or procedural basis for their decisions and (ii) grants an appeal right, during the course of any administrative proceeding, of de facto regulations and alleged violations of a named party's constitutional rights. The bill provides that upon filing an appeal, the administrative proceeding is stayed pending a final determination by a court of record.
