SUMMARY:

Workers' compensation; presumption as to definition of disease. Presumes carpal tunnel syndrome and hearing loss to be medically defined as diseases unless such presumption is overcome by a preponderance of competent evidence to the contrary, for purposes of claims for benefits under §§ 65.2-400 and 65.2-401 of the Workers' Compensation Act (relating to compensation for occupational diseases and ordinary diseases of life, respectively). The bill further provides that its provisions do not alter the claimant's burden of proof or exclude other ailments from potential coverage pursuant to §§ 65.2-400 and 65.2-401.
