SUMMARY:

Individual accident and sickness insurance provisions. Prohibits individual accident and sickness insurance policies, contracts or plans from containing a preexisting-conditions provision that limits, denies or excludes coverage for charges or expenses incurred beyond a 12-month period following an insured's effective date of coverage for a condition that had manifested itself during a 12-month period immediately preceding the effective date of coverage. Under the bill, in determining whether a preexisting-conditions provision applies to an insured, all coverage credits the time the person was covered under previous individual or group coverage if such coverage was continuous to a date not more than 30 days prior to the effective date of the new coverage, exclusive of any applicable waiting period under such coverage.
