SUMMARY:
Virginia Voluntary Formulary. Revises the procedure to simplify the steps and streamline the time for amending the Formulary. Although revisions of the Voluntary Formulary are excepted from the Administrative Process Act, the Formulary Board must currently hold public hearings on all revisions, recommend additions or deletions to the Board of Health, and obtain the Board of Health's acceptance of the amendment. This bill allows the Formulary Board to amend the listing of generic drugs (the Formulary) with the Commissioner of Health's approval and without conducting a public hearing, except in instances expected to generate some question. Public hearings must still be held for proposed listings of drugs that are not A category rated (therapeutically equivalent) by the Food and Drug Administration or for nonemergency deletions from the Formulary.
