SUMMARY:

HMOs; pharmacies; freedom of choice. Exempts a health care plan whose terms require utilization of pharmacies exclusively operated for the HMO providing the plan from the pharmacy “freedom of choice” provisions in current law. Existing law stipulates that an HMO cannot prohibit a person receiving pharmaceutical benefits from selecting the pharmacy of his choice or impose any fee or condition on such person that is not equally imposed upon all individuals in the same benefit category.
