SUMMARY:
Uniform Custodial Trust Act. Modifies the Uniform Act to allow any person to transfer property he holds for or owes to an incapacitated individual to a custodial trustee for the benefit of the individual, provided the court approves the transfer. The court may require the custodial trustee to post bond, with surety. Under current law, such a transfer may be made only to an adult family member of the incapacitated person or to a trust company. The bill is recommended by the Virginia Bar Association Elder Law Section.
