SUMMARY:

Durable power of attorney. Extends the rules to agents acting under a durable power of attorney which are presently applicable to guardians in cases where, during a testator's incapacity, property is sold by the guardian or where the proceeds of an insurance policy are paid to the guardian. “Incapacity” is a defined term meaning a lack of understanding or capacity to make or communicate “responsible decisions.”
