SUMMARY:

Solid waste facilities. Allows three categories of waste facilities to expand beyond waste boundaries existing on October 9, 1993. The three categories are: (1) nonhazardous industrial waste facilities located on property controlled by the generator of the waste, (2) nonhazardous industrial waste facilities on property not controlled by the generator provided the facility only accepts waste streams the facility lawfully accepted prior to July 1, 1995, or wastes approved by the Department of Environmental Quality, and (3) facilities that only accept construction-demolition-debris. This third category, prior to such an expansion, must either install liners and leachate control systems in the area of expansion or receive a variance from the Department. Sixty days prior to the expansion of category (2) and (3) facilities the owner or operator is to provide written notice, including groundwater monitoring data, to the Department. The Department is to evaluate the data and may advise the facility owner or operator of any additional requirements that may be necessary to ensure compliance with applicable laws and to prevent substantial hazards to health or the environment. All three categories are required to maintain applicable setback requirements.
