SUMMARY:

Property Owners' Association Act; condemnation of common areas. Provides that when any portion of the common area is taken or damaged by eminent domain, the property owners' association is to be a party, and payment, if any, is to be made to the association. The bill also authorizes an association's board of directors to negotiate with the condemning authority and bind the association as to any award amount. Members of the association are prohibited from contesting the association's actions with respect to a proceeding to condemn common areas.
