SUMMARY:

Volunteer Immunity and Charitable Organization Liability Limitation Act. Grants immunity to volunteers of § 501 (c)(3) charitable organizations while acting in good faith in the performance of their duties. The liability of these volunteers for injury and damages resulting from the operation of motor-driven equipment is capped at the limits of applicable insurance coverage, if any.

The liability of tax-exempt § 501(c)(3) organizations is capped at $300,000 per person and one million dollars per occurrence for injury or death or $100,000 per occurrence for property or other damage. The Act applies only to acts or omissions occurring on or after July 1, 1995, and does not apply to intentional wrongs, willful misconduct, criminal acts or breach of a fiduciary duty.
