SUMMARY:
Administrative Process Act. Exempts certain Department of Game and Inland Fisheries actions from the case decision provisions of the Administrative Process Act (APA). Currently, any action the agency may take with regard to licenses and permits may be challenged as case decisions, thereby putting the agency in the position of ultimately having to respond to questions relating to the issuance of thousands of hunting and fishing licenses and permits. By exempting these activities from the case decision provisions of the APA, the agency and the Office of the Attorney General will avoid the time and expense associated with responding to potentially numerous administrative and court appeals.
