SUMMARY:
Drug asset seizure. Requires notice of seizure for forfeiture to be served within 21 days of the seizure for forfeiture. A recent Virginia Supreme Court case evidenced confusion whether, in all cases, a seizure for evidentiary purposes would be the date of seizure for forfeiture. The statute contemplates the possibility of two different dates.
