SUMMARY:
Persons eligible for election to school board. Clarifies that deputies of constitutional officers may be elected to school board membership. Constitutional officers, as set forth in Article VII, § 4 of the Virginia Constitution, include treasurer, sheriff, an attorney for the Commonwealth, a court clerk, and a commissioner of revenue elected in each county and city; this measure addresses the deputies of these officials. Section 22.1-30 currently prohibits the appointment, but not the election, of state and local governing officials, relatives of members of county governing bodies, and school board employees from school board membership; statutory exceptions permit the appointment of notaries public, medical examiners, public defenders, and certain other individuals. In addition, § 15.1-50.4 includes a general prohibition against certain local officers holding more than one office; opinions of the Attorney General have previously extended this prohibition to deputies and have cited concerns under the Hatch Act (5 U.S.C. § 1502(a)(3)) regarding employees and officials whose principal employment is federally financed.
