SUMMARY:
Drug offenses. Expands current provision which makes possession of a firearm while in possession of a Schedule I or II controlled substance punishable as a Class 6 felony. The bill covers possession of any dangerous weapon while engaged in the unlawful sale, transportation, distribution or possession with intent to sell or distribute Schedule I or II substances or marijuana. The new provision is modeled after § 4.1-318 (violation of ABC laws by armed person) and the penalty (Class 6 felony) is the same.
