SUMMARY:

Virginia Fertilizer Act. Adds a requirement of written notice of certain changes in regulations to manufacturers of regulated products and alters labeling, permit and reporting requirements of the Act. The Commissioner of Agriculture and Consumer Services is required to provide written notice to manufacturers of fertilizer, soil amendments, soil conditioners and horticultural growing media of changes in regulations promulgated by him. Labeling requirements are clarified for soil amendments and horticultural growing media and a requirement is added that product labels list such ingredients as may be required through regulation. For horticultural growing media, a statement of added fertilizers now required to be shown on the product label would instead be required to be shown on the registration document and customer sales invoice. Particular types of compost which must be listed on product labels are identified. The application of a requirement that contract-applicators obtain a permit is restricted to only contract-applicators of fertilizer. The requirement is eliminated that contract-applicator permit applicants assure delivery of the quantity described in the consumer invoice.
