HB 1445 Pesticide applicators.

SUMMARY:

Pesticide applicators. Exempts those whose job duties include the application of nonrestricted use pesticides from the requirement that applicators of pesticides obtain a commercial applicator certification. The exemption does not apply when the nonrestricted use pesticide would be used (i) in areas open to the general public in educational, day-care and health facilities, (ii) in areas where food is stored, processed or sold, or (iii) on recreational land over five acres in size. The Pesticide Control Board may also, by regulation, exempt from certification two classes of persons: those whose use of pesticides will pose a minimal risk to the public because of (i) the nature of the pesticide or application method to be used or (ii) their experience and knowledge. The promulgation of regulations which create such exemptions and which set requirements for certification for those who must be certified is exempt from the Virginia Administrative Process Act if the regulations are adopted after having been considered at two or more Pesticide Control Board meetings and one public hearing. The Board shall consider and respond to petitions by interested parties with respect to reconsideration or revision of the regulations.
