SUMMARY:
Appeals of decisions of the Gas and Oil Board. Provides that court review of appealed decisions of the Gas and Oil Board will be subject to the standard for review established in the Administrative Process Act. This standard limits the scope of the court's review to issues of law, which includes whether the Board acted within the scope of its authority and whether the decision is supported by the evidence. Currently, this is the standard that would be applied if a coal owner or coal operator is not a party to the action. If a coal owner or coal operator is a party, the court action will be a trial de novo. This bill eliminates the existing procedural differences that are based on the identity of the parties.
