HB 1301 Child support; wage withholding.

SUMMARY:

Child support; wage withholding. Requires all new initial child support orders to include a provision for wage withholding unless the obligor and the obligee, or, in cases in which the Department of Social Services is providing child support services, the Department agree to an alternative arrangement. The agreement must be in writing. Currently, wage withholding is required for all cases in which the Department is providing support services; this bill expands that process to court-ordered support. If withholding is not ordered, the court must make a finding and explain why withholding is not in the child's best interests. Orders modifying initial orders may include a withholding order.

The bill authorizes all payments under a withholding order to be made to the Department and allows a fee, not exceeding lesser of $25 or the actual costs, to be charged persons who do not receive support services from the Department for processing the payments.

Wage withholding in non-IV-D cases is mandated by the federal government.
