SUMMARY:
Bifurcation of punitive damages actions. Provides that the trier of fact in civil actions involving punitive damages is, at the defendant's request, to first determine compensatory damages exclusive of any evidence of punitive damages which is to be heard in a separate proceeding. Except in libel or slander actions, punitive damages may not be awarded in the absence of an award for compensatory damages.
