Requesting the Secretary of Public Safety, with the assistance of the Joint Legislative Audit and Review Commission, to conduct an analysis of the overlapping of agencies with statewide police powers in the Commonwealth.

WHEREAS, the State Police, the Department of Alcoholic Beverage Control, the Virginia Marine Patrol, the Department of Game and Inland Fisheries, the State Lottery Department, the Department of Motor Vehicles and other entities all have certain police powers statewide; and

WHEREAS, the police powers of those agencies and their agents overlap; and

WHEREAS, the overlapping of those powers may result in unnecessary expenditures and occasionally does result in disagreements among those agencies about which is the proper agency to exercise those powers; now, therefore, be it

RESOLVED by the Senate, the House of Delegates concurring, That the Secretary of Public Safety, with the assistance of the Joint Legislative Audit and Review Commission study the need, feasibility, and advisability of placing all such police powers into the Division of State Police under the administrative control of the superintendent of State Police.

The Secretary of Public Safety, with the assistance of the Joint Legislative Audit and Review Commission, shall complete his work in time to submit his findings and recommendations to the Governor and the 1996 Session of the General Assembly as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents.
