Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended as follows:

§ 18.2-308.9. Transportation of rifles and shotguns; penalty.

It shall be unlawful for any person to knowingly and intentionally transport any rifle or shotgun in a motor vehicle unless such firearm is unloaded and locked in a gun rack or the vehicle trunk. Any rifle or shotgun transported in violation of this section shall be forfeited to the Commonwealth pursuant to the provisions of § 18.2-310, except that such firearm shall be subject to immediate seizure by the arresting officer and forfeiture to the Commonwealth upon commission of a violation. A violation of this section shall be punishable as a Class 1 misdemeanor.
