Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.1-33.5 as follows:

§ 15.1-33.5. Prohibiting panhandling in certain counties.

The governing body of any county operating under a county manager plan of government may provide by ordinance for the regulation or prohibition of aggressive begging or panhandling on public property or on privately owned property which is open to the public. The ordinance may include a provision permitting police officers to make arrests for violations of the ordinance not committed in their presence when any such arrest is based on probable cause upon reasonable complaint of the person who observed the alleged offense.
