Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 11-41.2:2 as follows:

§ 11-41.2:2. Design-build or construction management contracts for counties, cities, and school boards authorized.

Notwithstanding any other provisions of law to the contrary, any county, city, or school board may enter into fixed price or not-to-exceed price design-build or construction management contracts in accordance with procedures consistent with those described in this chapter for procurement of nonprofessional services through competitive negotiation. Such counties, cities, and school boards shall not be required to award a design-build contract to the lowest bidder, but may consider price as one factor in evaluating the proposals received. Such counties, cities, and school boards shall maintain adequate records to allow post-project evaluation by the Commonwealth.
