Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 3 of Chapter 3 of Title 24.2 a section numbered 24.2-310.1 as follows:

§ 24.2-310.1. Liability of owner of private polling place.

The owner of any private property used as a polling place shall not be liable for damages resulting from injury to the person or property of another [ which occurs (i) ] while the property is being used as a polling place [ and (ii) on the portions of the property used as a polling place or means of access to the polling place ] , when such injury was caused by an act or omission constituting simple or ordinary negligence on the part of the owner or any agent or employee of the owner in the maintenance or operation of the property.
