WHEREAS, the select committee has met and held hearings on abuse of the proffer system pursuant to its authorization by 1994 House Joint Resolution 280; and

WHEREAS, legislation will be introduced in the 1995 Session of the General Assembly to ameliorate some of the abuses; and

WHEREAS, the select committee is of the opinion further steps might be taken to lessen the financial impact the proffer system has on the cost of new construction; now, therefore, be it

RESOLVED by the House of Delegates, the Senate concurring, That the Select Committee [ of the House Committee on Counties, Cities and Towns and the Senate Committee on Local Government ] studying abuses in the proffer system be continued. The select committee shall continue to study abuses in the proffer zoning system and to recommend amendments to the system to end these abuses.

The current seven members of the select committee shall continue to serve with any vacancy to be filled in accordance with the original resolution.

The direct costs of this study shall not exceed $2,100.

The Division of Legislative Services shall provide staff support for the study. All agencies of the Commonwealth shall provide assistance to the select committee, upon request.

The select committee shall [ complete its work in time to submit its be continued for one year only and shall submit its final ] findings and recommendations to the Governor and the 1996 Session of the General Assembly as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents.

Implementation of this resolution is subject to subsequent approval and certification by the Joint Rules Committee. The Committee may withhold expenditures or delay the period for the conduct of the study.
