Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 11 of Title 2.1 a section numbered 2.1-133.5 as follows:

§ 2.1-133.5. Workers' Compensation Anti-Fraud Division.

A. There is hereby created in the Department of Law a Workers' Compensation Anti-Fraud Division which shall investigate and prosecute [ criminal ] fraud committed by any person in connection with claims made under the Workers' Compensation Act (§ 65.2-100 et seq.).

B. The duties of such Division shall be to:

1. Receive and investigate complaints of [ criminal ] fraud committed in connection with claims made under the Workers' Compensation Act (§ 65.2-100 et seq.);

2. Prosecute any person who has committed such fraud;

3. Establish and maintain statistical records of the Division's receipt, investigation and prosecution of fraud complaints in connection with workers' compensation claims filed pursuant to the Workers' Compensation Act (§ 65.2-100 et seq.); and

4. Prepare and provide periodic reports about workers' compensation fraud to the Department of Workers' Compensation and other governmental commissions, agencies and departments.

C. The Attorney General may appoint and fix the salaries of such attorneys and employees as may be necessary to carry out the functions of the Division, within the amounts appropriated to the Division, and may supplement such funds from appropriations made to his office for the provision of legal services to the Commonwealth.
