Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-250.2 as follows:

§ 18.2-250.2. Purchase of controlled substance unlawful.

It shall be unlawful for a person to purchase, negotiate for the purchase of, or solicit the purchase of, a controlled substance in a public place.

A violation of this section shall be punishable by confinement in jail for up to twelve months and a fine of up to $50,000, either or both. In addition, the court may require any person so convicted to provide up to 4,000 hours of community service.

Any property, including a motor vehicle, used to facilitate a violation of this section, or used in connection with an activity that violates this section, may be seized at the time of the arrest and permanently forfeited in accordance with the procedures set forth in Chapter 21.1 (§ 19.2-368.1 et seq.) of Title 19.2.

For purposes of this section, a "public place" shall mean an area generally visible to public view and includes alleys, bridges, buildings, street corners, driveways, parking lots, parks, plazas, sidewalks, streets open to the general public, and the doorways and entrances to buildings and dwellings.
