Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-1304.1 as follows:

§ 46.2-1304.1. Transportation of certain passengers in certain pickup truck beds prohibited; exception; penalty.

The governing body of any county, city, or town may by ordinance provide that no person fourteen years of age or younger shall be transported in the open bed of any pickup truck being operated on any public highway within the county, city, or town. No such ordinance, however, shall apply when persons being transported in the open bed of a pickup truck are seated in permanently installed seats and restrained either by a safety belt system as provided for in Article 12 (§ 46.2-1091 et seq.) or, if the passenger is under the age of four, by a child restraint device as provided for in Article 13 (§ 46.2-1095 et seq.).

Any such ordinance shall further provide that the driver of any pickup truck transporting a person in violation of such ordinance shall be subject to a penalty not exceeding that provided in § 46.2-113 for commission of a traffic infraction.
