HOUSE BILL NO. 2550 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the House Committee on Chesapeake and Its Tributaries on February 4, 1995) (Patron Prior to Substitute--Delegate Murphy) A BILL to amend the Code of Virginia by adding a section numbered § 62.1-44.15:02, relating to the State Water Control Board's authority to issue certificates.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 62.1-44.15:02 as follows:

§ 62.1-44.15:02. Board's authority to issue certificates; public notice.

If the applicant for a certificate to discharge has previously violated such a certificate, the Board shall not issue a renewal certificate to discharge unless the applicant has published certain information in a notice in a paper of general circulation in the locality where the facility is or will be located. The Board shall also publish certain information in the fact sheet associated with the renewal certificate application. The notice and fact sheet shall include, at a minimum: (i) the name of the applicant and location of the facility; (ii) any names under which the applicant has conducted business during the fifteen years prior to the application; (iii) the date and nature of any violation of certificates issued to the applicant by the Board during the previous five years; and (iv) the nature and proposed amount of discharge by the facility. Nothing in this section shall prohibit the application from including information about proposed or implemented pollution prevention practices.
