LD5786376Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 62.1-44.15:02 as follows:
§ 62.1-44.15:02. Board’s authority to issue certificates; public notice.
Notwithstanding any other provision of this chapter, the Board shall have the authority to issue, without publication of notice, a certificate to discharge to an applicant to whom the Board has not previously issued violations of permits. If the applicant has previously violated such a certificate, the Board shall not have the authority to issue a certificate to discharge unless the applicant has published certain information in a notice, in a paper of general circulation, in the locality where the facility is or will be located. The Board shall also publish certain information in the fact sheet associated with the certificate application. The notice and fact sheet shall include, at a minimum: (i) the name of the applicant and location of the facility; (ii) any names under which the applicant has conducted business during the fifteen years prior to the application; (iii) the date and nature of any violation of certificates issued to the applicant by the Board; and (iv) the nature and proposed amount of discharge by the facility. Nothing in this section shall prohibit the application from including information about proposed or implemented pollution prevention practices.
