Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 32.1-102.3:1.1 as follows:

§ 32.1-102.3:1.1. Application for certificate of public need not required of certain hospitals.

An application for a certificate that there exists a public need for a proposed facility to relocate or renovate shall not be required for a nonprofit hospital located in the City of Richmond if (i) the facility provides primarily ear, eye, and nose treatment; (ii) the facility seeks to relocate within the City of Richmond; and (iii) the facility decreases the number of licensed beds by more than fifty percent.
