Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 3.1-380.1 as follows:

§ 3.1-380.1. Inspection of retail food stores in localities with ordinances.

Notwithstanding the provisions of this article or any other law, regulation or memorandum of understanding to the contrary, the Department of Agriculture and Consumer Services shall not perform routine retail food store inspections in any locality where the local health department regularly performs retail food store inspections pursuant to an ordinance of the local governing body.
