LD4186156Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-277.1 as follows:
§ 8.01-277.1. Subpoena duces tecum.
A judge or clerk of court may issue a subpoena duces tecum for the production of writings or documents pursuant to the terms of Rule 4:9 of the Rules of the Supreme Court of Virginia in a matter not yet before the court on affidavit of the party applying for the subpoena that such information is needed to determine whether suit is necessary.
