LD6138264Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 65.2-809.1 as follows:
§ 65.2-809.1. Insurers to notify employers of claims and proposed settlements.
Every insurer securing the liability of an employer under this title through a policy of workers’ compensation insurance shall notify such employer of the following:
1. Any claim for benefits under this title, of which the insurer has notice, filed with the Commission (i) by any current or former employee of the employer, and (ii) seeking an award of benefits chargeable to such employer. The insurer shall notify the employer within five business days of receiving any information concerning such claim.
2. The insurer’s intention to settle any claim for benefits under this title (i) with any current or former employee of the employer and (ii) chargeable to such employer. Such notice shall be provided at least five business days prior to the settlement of any such claim..
