LD3508308Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-36.1 as follows:
§ 8.01-36.1. Recovery of lost earnings by permanently injured individual.
In any action to recover damages for a permanent injury, it shall be rebuttably presumed that prior to his injury, the injured individual was capable of working until sixty-five years of age and was capable of earning at least an amount equal to the average wage of the Commonwealth as set forth in § 65.2-500.
