A BILL to amend the Code of Virginia by adding sections numbered 30-19.1:5 and 30-19.1:6, relating to impact statements by the Virginia Sentencing Commission; legislation increasing terms of imprisonment.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 30-19.1:5 and 30-19.1:6 as follows:

§ 30-19.1:5. Impact statements to be prepared by the Virginia Sentencing Commission.

In conjunction with its duties under § 17-235, the Virginia Sentencing Commission shall detail the impact of each bill filed to which the provisions of § 30-19.1:4 apply. Such statement, filed with the clerk of the house in which the bill is introduced, shall include, but not be limited to, details as to any increase or decrease in necessary bed space, the effect on facility capacity, any necessary adjustments in guideline midpoints for the crime or crimes affected by the bill as well as adjustments in guideline midpoints for other crimes caused by the implementation of the bill which, in the opinion of the Commission, are necessary and appropriate based on projected correctional facilities capacity requirements and correctional resource needs, and the Commission's determination of the overall fiscal impact of the bill.

§ 30-19.1:6. Limiting time for introduction of bills which increase terms of imprisonment.

No bill to which the provisions of § 30-19.1:4 apply shall be introduced for consideration by the General Assembly after the first calendar day of any session of the General Assembly, unless requested by the Governor in accordance with the rules of the General Assembly.
