Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 30-19.1:5 as follows:

§ 30-19.1:5. Impact statements to be prepared by the Virginia Sentencing Commission.

In conjunction with its duties under § 17-235, the Virginia Sentencing Commission shall detail the impact of each bill filed to which the provisions of § 30-19.1:4 apply. Such statement, filed with the clerk of the house in which the bill is introduced, shall include, but not be limited to, details as to any increase or decrease in necessary bed space, the effect on facility capacity, any necessary adjustments in guideline midpoints for the crime or crimes affected by the bill as well as adjustments in guideline midpoints for other crimes caused by the implementation of the bill which, in the opinion of the Commission, are necessary and appropriate based on projected correctional facilities capacity requirements and correctional resource needs, and the Commission’s determination of the overall fiscal impact of the bill.
